TERMS & CONDITIONS
General
By acceptance of a quote, and subsequent payment of any booking, the Passenger acknowledges that they have read, understand and accept all Terms & Conditions herein.
Impact Wedding & Formal Car Hire t/as Impact Tours & Transfers (hereinafter referred to as Impact Tours & Transfers) reserve the right to alter the schedules of any service as it deems necessary. Whilst every effort is made to maintain the service, no responsibility will be taken for inconvenience due to delayed service and any additional cost or expenses.
Impact Tours & Transfers shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any other company or person providing services included in this transfer.
Impact Tours & Transfers accept no responsibility for any sickness, labour disputes, machinery breakdown, government restrains, acts of war and terrorism, weather conditions, traffic delays, defect in any vehicle of transportation that is caused.
Impact Tours & Transfers also reserve the right to cancel, change or substitute any service and to decline to accept or retain any passenger at any time for any reason.
Every effort would be made by Impact Tours & Transfers to ensure that vehicles arrive on time. Impact Tours & Transfers shall not be held responsible or liable for any delay that occurs which is beyond our control. Impact Tours & Transfers shall not be held responsible or liable for any delays caused by airline, passengers missing flight/ship or flight/ship time changes.
Payments
All bookings must be pre-paid by direct deposit (Electronic Funds Transfer) or cheque/money order mailed to Impact Tours & Transfers. In some instances, cash payment on pick up is available by prior arrangement with Impact Tours & Transfers. Method of payment is to be arranged with Impact Tours & Transfers at the time of booking.
Bookings are not confirmed until said payment is received. Confirmation of payment will be made in writing (via email or mail). If the passenger has not received said confirmation of receipt of payment, then a booking has not been confirmed.
Pick up/Drop off Arrangements
Impact Tours and Transfers will endeavour to contact the passenger (and/or the passenger’s representative – the person who made the booking) at least 24 hours prior to their service to advise of approximate pick up times. If a passenger has not heard from Impact Tours & Transfers within 24 hours of their service then the passenger agrees that it is their responsibility to contact Impact Tours & Transfers to confirm their service arrangements.
When the passenger agrees to a service pick up/drop off time the passenger acknowledges and agrees that sufficient time has been allowed by the passenger and Impact Tours & Transfers for the passenger to arrive at their destination by the passenger’s required time. If, for any reason, the passenger does not arrive at their intended destination on time the passenger acknowledges that the ‘Conditions’ aforementioned will apply and Impact Tours & Transfers will not be held responsible for any reason.
Access
It is the passenger’s responsibility to advise Impact Tours & Transfers of any access restrictions. In the case where the vehicle is unable to access roads or a particular location required, the driver will pull up as close as possible at his discretion, bearing in mind the safety of passengers, the driver and the safety of the vehicle.
In the event that Impact Tours & Transfers deem that it is unable to access a location, it will be the passenger’s responsibility to get from the revised drop off location to their requested location (ie the location that was not accessible in the Impact Tours & Transport vehicle). This will be at the passenger’s expense and the passenger will not be entitled to any refund from Impact Tours & Transfers.
Baggage
All baggage, including carry on baggage and personal items, is the sole responsibility of the passenger as Impact Tours & Transfers accepts no responsibility and shall not be liable for theft, loss or damage to any passenger baggage and/or personal items, whilst the passenger is on an Impact Tours & Transfers service.
Any baggage that is left aboard an Impact Tours & Transfer service will be carried to our office and stored at the owners risk for no more than 3 months.
Drug or Alcohol Intoxication
Impact Tours & Transfers can refuse to carry or remove from a service a passenger who, in the reasonable opinion of Impact Tours & Transfers, is intoxicated by drugs and/or alcohol and who may or may not pose a potential threat to themselves, others or property.
Any and all additional costs incurred as result of the refusal to serve, or the removal from the service, will be the responsibility of the passenger. Smoking is also not permitted by law on any Impact Tours & Transfers service.
Violent, Disorderly & Aggressive Behaviour
Impact Tours & Transfers hold, in the highest regard, the safety of staff and passengers. Violence, disorderly conduct and aggression will not be tolerated. A person may be asked to leave or refused entry onto an Impact Tours & Transfers service at any time, including at time of pick up and/or prior to reaching their destination.
If a passenger is, in the reasonable opinion of Impact Tours & Transfers, violent, disorderly or aggressive towards the driver, staff members or fellow passengers Impact Tours & Transfers reserve the right to refuse travel or to remove a passenger from the service. Where deemed necessary by Impact Tours & Transfers, the police will be requested to attend.
Refund and Cancellation Fees
Cancelling a confirmed and paid booking will result in the following cancellation fee (with the exception of Weddings):
- Less than 72 hours notice prior to your pickup booking scheduled time, will result in a cancellation fee equal to 100% of the total booking price.
- Between 72 hours - 15 days notice prior to your pickup will result in a cancellation fee equal to 80% of the total booking price.
- Between 15 days - 30 days notice prior to your pickup will result in a cancellation fee equal to 50% of the total booking price.
- Between payment of booking - 30 days notice prior to your pickup, will result in a cancellation fee equal to 20% of the total booking price.
Weddings: The deposit is non-refundable. Balance of payments are required 10 days prior to the wedding date. If a cancellation is requested after the balance payment is made, the following cancellation fee will apply to the balance proportion only (deposit non-refundable):
- Less than 7 days notice prior to your wedding date, will result in a cancellation fee equal to 100% of the total booking price..
- Between 7 days to 10 days notice prior to your wedding date, will result in a cancellation fee equal to 80% of the total booking price.
- Up to 10 days notice prior to your wedding date, will result in a cancellation fee equal to 50% of the total booking price.
Transfers are to and/or from destinations which are specified and confirmed in your quote/booking only. These destinations will be confirmed in writing at the time of booking.
Changes to bookings with less than 72 hours notice are not permitted (this does not apply to late running flights or flights cancelled by an airline - evidence may need to be provided by the passenger in relation to cancelled flights). In this regard the aforementioned cancellation fees will apply.
With the exception of the above paragraph, Impact Tours & Transfers permit changes to bookings at their discretion, however the passenger agrees that any such changes need to be made in writing by the passenger and, where possible, Impact Tours & Transfers will implement such changes if they are able to around other bookings. This however is not guaranteed by Impact Tours & Transfers. Impact Tours & Transfers reserve the right to amend quotations to accommodate any requested changes. In the event that Impact Tours & Transfers are not able to accommodate requested changes and the passenger decides not to proceed with their original booking, the aforementioned cancellation fees will apply.
The passenger agrees to notify Impact Tours & Transfers if their flight/ship is late departing their last port and the passenger anticipates not arriving at their pick up point on time (this can be done via smsand/or email). The passenger will advise Impact Tours & Transfers at the earliest time of the details of the delay including the amount of time delayed.
If the passenger fails to notify Impact Tours & Transfers of any delay, and Impact Tours & Transfers arrives at the pre-arranged pick up time, to discover the flight/ship is running more than 30 minutes late then Impact Tours & Transfers reserves the right to return to it’s base and/or next booking.
In the instance where Impact Tours & Transfers have made the pre-booked journey to the airport to pick up a client and the client has failed to notify Impact Tours & Transfers of their delay (via email or sms), then no refund will be given as Impact Tours have made the requested journey at the requested time. It is at the discretion of Impact Tours & Transfers how long they are able to wait. This will depend on other commitments and/or bookings following the late passengers booking. The passenger and Impact Tours & Transfers agree that Impact Tours & Transfers will not be required to wait more than 30 minutes for late flights/ships.
Impact Tours & Transfers will attempt to contact the passenger to determine how late the passenger will be and advise whether or not the service is able to wait. Extended waiting time may incur an additional fee, and this is at the discretion of Impact Tours & Transfers. If Impact Tours & Transfers are unable to make contact with the passenger then Impact Tours & Transfers will send an SMS to the passenger (or the contact person given who made the booking) advising what the situation is in relation to the service (ie, arrived at scheduled time, waited how long and had to leave due to other bookings/pick ups). The passenger agrees, in this instance, they will make other transportation arrangements at their own expense.
Refunds will occur (for the proportion of the journey) in the instance where the passenger’s scheduled flight/ship arrival times are delayed and the passenger has given sufficient notice (via email or sms) to Impact Tours & Transfers and Impact Tours & Transfers are unable to re-arrange it’s schedule to accommodate the changes. Where such changes occur the client agrees that they will fit in around Impact Tours & Transfers' schedules and/or prior commitments. The client agrees that 4 hours after clearing customs (ie 4 hours + 1 hour after flight arrival for international flights or 4 hours + 30 minutes for domestic flights) is an acceptable waiting time when the client's original booked return flight arrangements have been changed. If the client does not wish to wait for the abovementioned times to allow Impact Tours & Transfers to provide them with a bus service then the client agrees that no refund is payable and the client will make other transportation arrangements at their own expense.
Definitions
Impact Wedding & Formal Car Hire t/as Impact Tours & Transfers (referred to as Impact Tours & Transfers) includes the Partners of the business and any employees they may employ from time to time.
Passenger includes the person who has made the booking and/or any other persons using/travelling on our services for which the person who has made the booking is representing.
Service includes any transportation in any vehicle/s owned and/or operated by Impact Tours & Transfers.
Baggage includes all items which accompany a passenger whilst aboard an Impact Tours & Transfers service, either within the baggage compartment of the vehicle, trailer or carried on board by the passenger. The total amount of baggage entitlement per person is two pieces excluding carry on baggage.
